Arizona's Police Check of Immigrant Status on Hold

July 28 (Bloomberg) -- Arizona was barred from enforcing portions of a law set to take effect tomorrow that would have required police to ascertain the immigration status of individuals they stop for questioning, a federal judge ruled.

U.S. District Judge Susan Bolton in Phoenix held today that the state can’t mandate that police make a “reasonable attempt” to determine whether a person is legally in the U.S. and then detain him if there is “suspicion” that he is not. Arizona Governor Jan Brewer said she will appeal the ruling. Read more:

Which government entity holds authority over immigration?

I'd give $100 to anyone who can find the authority delegated to the federal government. In all the words used in the Constitution, the word immigration appears not once. It is not in the original document. It is not in the amendments.

So how do we know which government is in charge of immigration?

We read the document and locate information that tells us what we want to know.

It is there. It appears in Article 1, Section 9. The truth is that immigration is a power left to the States. Article 1, Section 9 states that "The migration or importation of such Persons as any of the States now existing shall think proper to admit, shall not be prohibited..." Who thinks proper? "the States now existing..." This clause applied solely to slaves and is no longer in effect because 1) we passed the date, 1808 and 2) we passed the 13th amendment. The key point is however that the States "admit" persons, not the federal government.

The feds usurped immigration authority around 1906. Why the States haven't stood up and told the fed to go to hell, I have no idea. Gutless like every politician perhaps. Regardless, the Constitution left immigration AND naturalization to the States. The Constitution does require that the feds create a single uniform rule of naturalization that the States follow. This also means EVERYONE naturalized by the feds is NOT A CITIZEN because the fed has no authority to naturalize.

Only fools and stupid people believe the fed has any of this authority. Those who have not independently studied our history and our Constitution have been brainwashed by the government schools. It is a sorry state of affairs we have. We speak of following the Constitution but I know that 99.99% of those who read the Constitution still do not comprehend the document.
